Terms of Service

1. Acceptance of Terms
By accessing or using the services provided by Just Make the Food Inc ("JMTF", "we", "us"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the service.
2. Description of Service
JMTF is a software platform that provides restaurant businesses ("Restaurants") with tools to operate their business, including online ordering, voice AI ordering, missed-call SMS, custom websites, delivery dispatching, payment processing infrastructure via Stripe Connect, and administrative dashboards.
JMTF is not a payment processor, marketplace, or merchant of record. Restaurants are independent businesses that contract directly with payment processors and delivery networks. JMTF provides software infrastructure that connects these services.
3. Restaurant Accounts
Restaurants who use the JMTF platform agree to:
- Establish their own Stripe Connect Standard account and remain the merchant of record for all transactions on their site
- Provide accurate business information, menus, hours, and pricing
- Comply with all applicable food safety and tax laws
- Handle customer service, refunds, and disputes related to their products
- Maintain valid integrations with third-party services (POS, delivery networks, payment processors)
4. Fees
JMTF charges restaurants a flat $1.00 platform fee per online order, collected at the time of order placement as a customer-visible service fee through Stripe Connect's application_fee_amount mechanism. No subscription fees. No percentage fees. Voice AI is billed separately on a per-minute basis. Other paid add-on services may be offered with separate pricing disclosed at the time of opt-in.
Standard payment processing fees from Stripe (currently 2.9% + $0.30 per transaction in the United States) flow directly between the restaurant and Stripe and are not collected by JMTF.
Delivery network fees (DoorDash, Uber, Grubhub) are passed through to the customer at the rate quoted by the network at the time of order. JMTF does not mark up delivery fees.
5. Payments and Money Flow
All customer payments flow directly through Stripe Connect to the connected account of the restaurant where the order was placed. JMTF does not hold, route, or process customer funds. JMTF's platform fee is collected automatically by Stripe and routed to JMTF's platform Stripe account on each transaction.
Restaurants are solely responsible for all chargebacks, refund decisions, dispute resolution, and tax reporting (including 1099-K) on transactions through their Stripe Connect account.
6. Customer Orders
Customers placing orders on a restaurant's JMTF-powered website are entering into a contract with that restaurant, not with JMTF. JMTF provides the technical platform but is not a party to the transaction.
The $1.00 service fee is collected by JMTF as a software platform fee. Customer questions regarding the food, order, delivery, or refunds should be directed to the restaurant.
7. Termination
Either party may terminate this agreement at any time. Upon termination, JMTF will deactivate the restaurant's account. Restaurants remain responsible for completing or refunding any orders placed prior to termination.
8. Limitation of Liability
JMTF's services are provided "as is" without warranties of any kind. To the maximum extent permitted by law, JMTF's total liability for any claims arising out of these Terms shall not exceed the platform fees paid by the affected restaurant in the six months preceding the claim.
JMTF is not responsible for outages or failures of third-party services (Stripe, POS providers, delivery networks, voice AI providers) integrated into the platform.
9. Changes to Terms
We may update these Terms from time to time. Material changes will be communicated to active restaurants via email. Continued use after such notice constitutes acceptance of the updated terms.
